Resp. All, I have a query, plz. give your views! Suppose, an organization has Sunday as their Weekly-Off. Now, if an employee Joins the organization and has to report at their Zonal Office on Monday for Training. But, he starts from his place on Sunday by train, and he argues to make that Sunday date as his Date of Joining.
Now, my query is, Is it possible to make a Sunday the date of joining for new employees, whereas as Sunday is the weekly-off of the organization and no working was held on that Sunday? Please give your valuable guidance in this regard.

Hi Bhuwan,
It is not possible in any case to make weekly off as a date of joining.
If any new joinee is asking for this then you should firmly tell that it is not possible. If the person is travelling a day day before you can only reimburse the travel expenses.
Lot of time it happens that people have to travel long distances in or outside country for joining new organizations (for joining / training / induction etc) but the travel dates could not be considered as DOJ.

This seems to be a strange request. The date which employee reports for work is the joining date and not the date he/she boards train/bus. So we no need to consider DOJ as Sunday

Hi,
I find some skew in this query. Without taking the employee first in employment (without getting formal joining and completing joining formalities), he is directly advised to report for training and this skew has created problem as stated. If joining formalities have been completed and joining report had been obtained, there would have not been such problem.

To earn a weekly off, one should work six days in a week. It is strange that a prospective candiadte for employment insists on weekly off even before joining the job and becoming an employee and without putting in even a day's work.

we can make sunday as joining if an organisation is working 24/7. here, the peculiarity is the candidate is asked join and to go for training. Since the organisation is has not give time to join and go for training, he should be given a fair opportunity to compensate working day with max of travel expenses reimbursement for the amount of tension and stress & strain undergone. HR should have some flexiblity in creating first day comfort. This may b not thought of in Banking sector.

What type of industry do you work with, is that an IT company or any Industry? Again "he argues to make that Sunday date as his Date of Joining" what does that mean? How can a candidate before joining, argues with the HR personnel?
Joining date can be on a public holiday or any weekly off, if the company or the team works on that particular date. In your case the person will be traveling and would join the organization on Monday. In this case it is very much clear that the joining date would be the date when an employee joins an organization and not the day when he/she travels, thinks, prepares, decides, etc to join an organization.

Mahesh rightly pointed out that a candiadte does not become an employee from the moment he makes up his mind to join a company.and It is always advisable to standardise your recruitment procedures so as to be uniformly applicable to all candiadtes to avoid dilemmas of this kind.However as one member suggested you can explore the ways of reimbursing their travel expenses as a good will gesture and can make it apart of company's policy.

@Mahesh Nair Sir & Sai Consultant: Sir, I am in a Pharmaceutical Company. Our recruitment cell final a candidate for the post of ABM for our Cuttack Branch. The candidate was have to Join and our Zonal Office, which is in Hyderabad for completing Joining Formalities and Training. As the candidate was already final from the management, so Offer Letter was given to him and was asked to report at the Zonal Office on or before 23-09-2013 for further process. He joined on 23-09-2013 there and completed the formalities and started training. The traveling expenses was paid to him from the Zonal Office.

Meanwhile, his Appointment Letter and other formalities was done at HO. His Appointment Letter was sent from HO to Zonal Office and handed over to him by the Regional Manager. He took it, received the copy and didn't said anything. When he was paid salary for the m/o Sep. 2013, then he started saying that as he was started on Sunday from his place, so his doj should be on Sunday (22-09-2013) and he should be paid from that day only.

This is the actual situation. Plz. guide, what other possibilities could be there..??

If that be the case where a person leaves his home on a sunday to commute and reach his place of work the following day, usually in places like Mumbai, people leave their homes at 06.00 hours morning to reach their place of work at say 08.45 hours. the office hours being 09.00 hours to 17.00 hours, would it mean the person office timings would end at 13.00 hours simply because he / she left home at 06.00 hours?
