Is there any legal action taken if any company is deducting the PF from employees' salary but not giving it to them when they are resigning from organizations? Even after 6 months of their notice period completion, it is not given, and neither is the question entertained.

Dear Sushil In your case you can get the attestation from ESI authorities/any gazzeted officer on PF withdrawl forms to claim(Enclose the Salary slip which shows the pf deduction). Cheers Karthik.

First, you should contact your company officials. If you are unable to do so, you may have your form attested by your bank manager, municipal councillor, member, chairman, mayor, member of parliament, legislative assembly, legislative council, gazetted officer, or member/trustee of the EPFO board.

Dear Sushil,

If company officials are not signing the PF withdrawals, then any gazetted officials are authorized to sign the said documents.

If company officials are refusing to sign or if the establishment was closed, then write an application to the concerned PF Commissioner and mark a copy to the Area PF Inspector. Submit the withdrawal form; based on that, the commissioner will issue an order to the concerned inspector for inspection. After that, the inspector will have to sign the same documents for necessary withdrawals.
