An employee can avilail E.L.during notice period, as per appointment letter one month notice period of confirmed employees. If he avail E.L. during notice period can we extand his notice period against E.L., please advise how can treat his E.L.

Employee cannot avail any kind of leave during notice period. If he has availed any laeves, those no. of days can be extended as a notice period.

An employee can avail EL during the Notice period.
For taking EL the employee had to submit the application for leave at least with 15 days before availment of EL to the employer, as per Factories Act, it is management discretion to sanction the leave or not basing on the requirement of the services of such employees.
The notice period is called for the very reason that the work or the department where the employee is working presently should not suffer after such employee leaves his services with the organisation, hence in order to replace some other employee in his place and train him and guide him with the works that the employee leaving the services used to look after.
Under the natural justice also a person who had tendered his resignation should not take any leave and be a trouble some to the organisation it is unfair and illegal.

It is purely depend on company policy, i don’t think so any rule regarding non availment of EL when notice period.

it may also happen that if ay employee is taking leaves during the notice period, it will be counted as LWP(Leave Without Pay)

It’s not like that. LWP is marked only when he/she is having no any earned leave in his/her account and employee proceed on leave with the consent of the HOD. Paramjit
