Hi all,

We are a 1-year-old manufacturing company in Tamil Nadu. We have not registered under any act except the registration of our factory. Our head office is in Tamil Nadu, and we conduct business both within Tamil Nadu and outside the state.

We are seeking clarification on which act we should register under - whether we can opt for the Shop and Establishment Act or the Factories Act. Additionally, we would appreciate guidance on the registration process for the applicable act.

For the unit where manufacturing activity is carried out, the Factory Act is applicable, and you should obtain licenses under the Factories Act. For your other units like the head office where no manufacturing activity is carried out but only services are provided, the Tamil Nadu State's Shops and Commercial Establishments Act will be applicable. For registration under the said Act, you have to contact the Labor Department of the respective area.

Thank you sir. 1 more question sir does Form-R comes under Tamil Nadu State’s Shops and (Commercial) Establishments Act. What are all the forms includes in this act?
