Hi friends, this is a case new to me I heard from somewhere.

One of the employees in the organization died while working in the factory. The factory was started recently. The process was initiated, and on the fourth day, the worker died due to an accident on the factory premises (age of the deceased worker is 28 years, unmarried, with father and mother as dependents). The factory has a license from the Inspector of Factories, and the worker's name is recorded in the attendance register.

The management wants to help his family. Could you please review the case and provide your valuable suggestions?

Dear G.V.B.VARAPRASAD,

Who is stopping the management from extending statutory and non-statutory help to the family members of the deceased employee? Extend help in getting benefits from the ESI Corporation, and if the worker was not covered under this Act, then give compensation as per the Workmen's Compensation Act, 1923. Grant ex-gratia amount to the dependents of the worker. You may also discuss the matter with his dependents.

First, thank you for your reply. The factory has recently started operating. After his death, they submitted the ESI and PF coverage forms. How can they benefit from the ESI & PF? Can you please explain?

You have mentioned that he was not covered under the ESI on the day of the accident. Therefore, how will the ESI Corporation help you? He was on the company's rolls. If he was working in the capacity of a workman under the Workmen's Compensation Act, 1923, then compensation should be paid according to this Act. For added security, you may also want to visit the local ESI Office for more information.
