Hi Friend,

I have to renew my factory license under the Factory Act of 1948, but I have one confusion. Currently, we have a sanctioned load of 250 HP (Electricity), and two months ago, we bought 2 Generators of 419 HP, which I am using in the absence of electricity. So, my query is, do I have to apply for the license based on 250 HP or 419 HP?

Kindly clarify, and are there any rules under the Electricity Act or Factory Act?

Dear,

You have to obtain the license under the Factory Act for 290 hp, but you also need to seek permission from the local electricity board under the Electricity Act for using a generator of 419 hp.

You mention your total load in the License and for Generator, you have to take permission from the local electricity board.

According to the Punjab Shops & Commercial Establishment Act, 1958, banks are covered under this act, which is applicable in the States of Punjab, Haryana & UT Chandigarh. Similarly, you may refer to this Act for the State for which you want to have the required information.

According to me, if you apply for an amended power, it is mandatory to provide proof to the department explaining why you are increasing your power or manpower. I believe you will need to re-implement your factory maps and also obtain a No Objection Certificate (NOC) from the Electricity Department.

Dear Vijayeta,

This is to inform you that we do not have any license under this Act. This Act is applicable in the State of Haryana, Punjab, and UT Chandigarh. We are required to get our establishment registered under this Act from the concerned authority, i.e., the area Shops Inspector. The registration procedure is provided under Section 13 and Rule 13 of the said Act. You can approach the office of the Registering Officer for this purpose.
