Hi
I worked as a an employee of an IT company. I resigned from there and leave the company . But they stopped my last month salary. I have recived my salry slip. where that have deducted my pf and income tax. Please advice me is there any legal advice available for this . How any company can stop the salry even if they have deducted Pf and Tax on salry.Is it legal for the company to do this practice. please advice me lagally

Dear Deepak,
As per HR policy. when you are given the notice period or serving the notice period, In that particular month salary company won't deduct for any PF, Insurance , IT and RDS.. like..etc. So you ask that HR people immediately and get the salary. Because you have full rights to ask them.

But i have not recived any salary for the month . even if they have deducted it from the salry slip . i have the proof of last month salry slip. please tell me if there is any legal sort is available for this.

dear yes if ,there is legal action for this . you can file a case under payment of wages act 1936 section 15(3) for delayed payment. tks j s malik

Dear Deepak,
There is a possiblity to pay your salary for that month with the Full & Final settlement. In case, you do not have recd your salary then you can ask to HR deptt how they have calculated your f & f settlement and if you do not recve any satisfactory answer then you can go for the legal action. But my suggestion to you pls wait and keep patience.

Every organisation deduct one month salary but u r saying that your pf also deduct then this is legal matter.
if they deduct one month salary that is right of 30 days notice.
but your pf require is full paid to you.

Dear Deepak,
While joining, If you signed any Hr rules or policy of the company that "you have to repay your last month salary while u resigning" or something related to that.....
then u can't,
check the copy of hr policy or rules that you have signed before,
If not such words found,
Check with the Hr people first, if they are not responding correclty
you can file a case for the delay as per Mr.Malik sir said

Dear Deepak,
Gyan is absolutely right. You shall get your salary after your Full & Final Settlement. Generaly companies take about 30 to 45 days(after your Last Working Day) to process F&F. If it has been more than 45 days, then you could first of all approach your HR person and ask about the details. I don't think that your company would have intentions to stop your salary. I feel it's just a process flaw or a delay in the compilation. So, i would advice you to be patient.

Hi Lakshmanan,
Even i would like to know the law as per which a company should not deduct for any PF, Insurance , IT etc in the last month(that is the the month considered as notice period) of an employee. i have never heard of it. Is there really a law for this?

Dear Deepak,
Dont get confused, my points are,
1. Have u submitted your resignation to the management? If so pl check with HR whether they have received or not. If they received they wont process your salary, they will do only Full and Final settlement.
2. Received your Salary slip means...you personally collected the slip from the company or received by courier/post?
3. Have you followed Company's Notice Pay guidelines as per your appointment order? Pl check your appointment order now.
