Can an employer force an employee to go on leave (with or without pay), or would such an action amount to unfair labor practice under the Industrial Disputes Act? It would be helpful if relevant sections of the concerned legislation are quoted with any available judicial precedents.

Thanks,
Prashant

Compelling an employee to take leave is unfair practice though there is no explicit provision in the fifth schedule to the Industrial Disputes Act. Regards, Madhu.T.K

Lay off is always a temporary arrangement. Any lay off following the provisions of the Industrial Disputes Act is legal. Regards, Madhu.T.K
