Dear Friends,

I would like to have legal advice on a very important matter from my expert friends here. I was working with an Oil PSU; however, due to some unavoidable circumstances, I was unable to attend the office. But, I was continuously in touch with my office through letters. In spite of this, my office has published a Public Notice in a Newspaper for my absence from the office. Further, it also lied in the Public Notice that there has been no response whatsoever for any of the letters sent by the office to me, from me. But I have proofs of my response to my office, where my office itself is quoting/referring to my letters.

I just would like to know whether I can have legal recourse for the same against my Office, which has blatantly and brazenly lied, and that too through a Public Notice. Also, kindly shed some light on the circumstances/situations in which a Public Notice for absenteeism can be published in the newspapers and also the legal provisions vis-a-vis the same. As its PSU, rules will be tough and will involve all those lengthy legal matters. For example, if you want to prove that you sent letters, you need to show the registered post copies, delivery proof, and all those legal documents. It's better to get in touch with a Chief Director and explain your problem to them.

Dear company,

If you are not receiving their letters and not replying to their letters, the company can publish in newspapers. You have to prove during the enquiry that you were sending continuous letters to them. Now, you should send a letter to them stating that publication will inform them of your problem.

Now, the question arises regarding disciplinary action against you. In that case, it will be necessary for you to prove that your absence was beyond your control. You cannot simply be absent for a long time without a proper reason.
