Dear All,

Are there any mandatory provisions that contract labor should be paid for National Holidays (15th Aug, 26th Jan, etc.)? If yes, then which provision?

In general practice, companies extend the benefits of Paid Holidays to contract laborers. Your comments on this, please.

Dear Rahul ji,

If you go through the Contract Labour Act, the act is also closely related to other acts like the Factories Act, PF, ESI, Gratuity, Bonus, etc. If the principal employer declares a holiday for their establishment, it automatically applies to the contract labour as well. However, when there is an agreement between the principal employer and contractor regarding the declaration of National & Festival Holidays, both parties should be bound by that agreement.

Under the National and Festival Holiday Act of 1963, it is clearly mentioned that employers have to pay wages for national and festival holidays declared in the list of holidays to the factory department.

We are working in a factory in Andhra Pradesh, and the contractor is only providing 3 paid holidays to his employees (15th August, 26th January, and 1st May). Is this correct? We provide 8 holidays to our own employees as per the National and Festival Holidays Act.
