Hi All,

Please let me know whether May 1st should be declared as a compulsory holiday for all companies, or whether it can be at the discretion of the management to exclude it from the list of holidays.

Dear Priya,

Greetings.

As per the National and Festival Holidays Act, the following national holidays have to be declared as holidays in any establishment:

1. Republic Day (26th Jan)
2. May Day (1st May)
3. Independence Day (15th August)
4. Gandhi Jayanti (2nd October)

Any employer who contravenes the above will be penalized as per the Act.

Hi Padma,

As per the Tamil Nadu Industrial Establishments (National and Festival Holidays) Act of 1958, May 1st is a national holiday for which employees are entitled to a holiday with pay.

Hi,

I am from an International Call Centre. Here, we do not give Indian holidays; instead, we provide employees with US holidays. In this case, is it still mandatory to give the employees US holidays in addition to Indian holidays?

Hi Dsouza,

That depends from company to company. Some companies give Indian holidays, while others provide holidays according to the USA. However, this also depends on the employment contract signed between an employee and employer. The contract mentions whether USA or Indian holidays will be given.

Dear Padma,

As per the Tamil Nadu Industrial Establishments (National and Festival Holidays) Act, May 1st may be included in the list of holidays applicable in Tamil Nadu. However, according to the National Festival and Holidays Act, May 1st is not a national holiday, and it is not compulsory to add it to the list of holidays.

National holidays such as January 26th, August 15th, and October 2nd are fixed, while festival holidays, including May 1st, are to be decided by the management with the concurrence of the workers.

Hi,

If employees work shifts for the USA/UK and follow USA/UK holidays, for example, if they work on May 1, 2017, is there an approval form required by the Karnataka Labour Office? Do we need to submit a letter and obtain a signature from the Labour Office since our employees work for the USA/UK and observe USA/UK holidays? Please advise if there is a specific form that needs to be signed by the Karnataka Labour Office.

We too do not have a holiday for May 1st. It was told that only laborers who work for the factory will be entitled to a holiday. The PF office, ISRO, and post office are all working today. Hence, we are not entitled to a holiday.

Any idea how a holiday is declared and how it is considered?
