Hello,

We have 12 PL, 12 CL, and 6 SL for all regular employees, and for Trainees, we are giving 1 day leave per month. This leave process is based on the calendar year from 01 Jan to 31 Dec.

My questions are:

- Is there any maximum number of days of PL to carry forward to the next year?
- What is the maximum number of days to avail CL at a time?

Can anyone suggest a good leave policy for an IT company?

Dear Seema,

PL = Number of days present in the last calendar year / 365 * 24. Number of PL not consumed in the current year will be carried forward to the next calendar year. Here the company can fix a maximum limit. For example, a maximum limit of 105 days as a balance can be maintained for each employee. If the balance overflows, it can be encashed in January salary or it can have an age factor as well. For example, if an employee attains the age of 50, he can maintain 240 days as a balance, and so on.

CL and SL are fixed by the management of the company and depend on the company's policy. At a time, 3 days can be granted as CL, which also differs from C2C and P2P.

I have one more query in mind. If an employee takes 4 consecutive days of leave, can these Casual Leaves be converted into Paid Leaves?

Also, could you please suggest the leave policy as I will be starting from the new year? All rules, regulations, and processes related to leaves are to be included.

Hi Seema,

As far as my knowledge goes, there is no specific rule on how much PL can be carried forward to the next year. However, there is a limitation for the accumulation of PL. An employee can accumulate up to 240 days of PL.

The maximum number of days to avail CL at a time depends on the company's rules and leave policy. In our company, an employee can avail 3 days of CL at a time.

Dear Seema, If employee take 4 Days Leave it can be treated as Long Leave and Can be clubbed under PL.But rules has to be framed towards it before implementing. Regards Rukuvijay

SL and CL do not have any specific calculation. It is mutually agreed upon and provided by management based on an understanding of the leave culture in the locality, working atmosphere, and the organization's previous years' leave consumption, maybe over the past five years or so.

I think its for only for CL not for SL. SL is also credited on the base of preset day like for PL. Regards, Ajay

The maximum carry forward of the PL should be set at 45, and the Encashment should be made at the time of separation. The maximum number of leaves that an employee can take at a time is 3 CL. If they take more than 3, for example, 7 or 8, the remainder can be taken from PL. The PL policy should be based on DOJ. For every month that an employee completes, they will be given 1 PL. This ensures that everything will be fine.

Leave rules will depend on the Standing Orders framed and certified by the company following the Industrial Employment Standing Order Act. Therefore, it is always desirable to refer to the Standing Orders whenever there is any doubt.
