I am working in a DTH (Direct to Home) company in Tamil Nadu. My doubt is whether the Tamil Nadu Shops and Commercial Establishment Act of 1947 will apply to the company, or if any other act will apply. In what category will the labor in our DTH company be represented as per labor law? It is not a factory; hence, the Factories Act will not apply. Please help me out.

Dear Gigi,

Please refer to sec 2(k) & (m) of the Factories Act and ascertain whether your company falls under the Factories Act or the Shops & Establishment Act. In either case, all other labor statutes applicable to Tamil Nadu will apply.
