Dear Members, Please guide me on Maharashtra BOCW rules. We have a manufacturing company registered under the Factory Act. We are planning for construction and expansion in our plant. For this purpose, we are deploying a construction company as a contractor. Is it mandatory for us to get a Registration Certificate (RC) under the BOCW Act and obtain a license from the contractor?

Applicability of BOCW Act to Factories

The BOCW Act will be applicable to your factory. The construction work is different from the manufacturing work. The factory license is granted to you for manufacturing-related work and the workers engaged in those manufacturing activities. The provisions relating to safety, health, welfare, and other service conditions as detailed in the Factories Act will be applicable. However, in respect of employees engaged in the construction work, the service conditions as per the Building and Other Construction Workers (Regulation of Employment and Conditions of Service) Act, 1996 will have to be made applicable. The objective of both acts is the same. The BOCW & The F.A. 1948 is talking about regulation of employment & working conditions of labors.
