I served in one company for 8 years, and I don't have much knowledge about gratuity. After leaving the company, I thought gratuity also comes after some time. But now it's been 6 months, and when I asked for my gratuity amount, they told me it's not the company's policy to provide gratuity to employees.

Please help me understand what the next steps I should take are, or if it's possible to apply for gratuity after 6 months.

Hi,

Paying gratuity is not related to company policy. Gratuity payment is purely considered under the Payment of Gratuity Act. If there is a delay, try to explain to them to release your gratuity; otherwise, you may send a legal notice to that company.

First, write a request letter to your employer requesting them to release gratuity based on your eligibility criteria, which is the total number of years served with the company. You can send the request letter through Registered Post with Acknowledgement Due (RPAD). Preserve a copy of the letter and the RPAD receipt.

In case of no response from the employer, you should escalate the matter to the Assistant Commissioner of Labour in your jurisdiction, who is the Controlling Authority as per the Gratuity Act.
