Clarification on Workman Classification Under the ID Act
My friend works as a Diploma engineer on a contract basis. He has two subordinate electricians, and he earns rupees 19,000 per month. Can you clarify whether he falls under the category of a workman as per the ID Act?
In the first paragraph explaining the definition of a workman, it is mentioned that individuals performing supervisory work for hire or reward are considered workmen. However, in the following part, it is stated that individuals with managerial or supervisory roles do not fall under the category of workmen. Furthermore, a supervisor earning ten thousand rupees would not be classified as a workman. Could you please provide clarification on this matter?

Determining Managerial or Supervisory Roles
The mere designation of being a Supervisor or Manager is not the test. The pertinent question is whether the person is employed in a supervisory capacity or discharges functions mainly of a managerial nature and draws wages in excess of Rs. 10,000/-.
Evaluating Subordinate Management
As regards the subordinate electricians, is he sanctioning their leave, writing their appraisal reports, sanctioning increments, exercising disciplinary powers, etc.? Despite being named a supervisor and drawing wages above the ceiling, one could still be a workman if the above-mentioned tests are answered in the negative.
