Resignation Dispute: Last Working Date Change and Employee Rights - CiteHR

Hi there, I have resigned from my current organization in accordance with the company policy of a two-month notice period. I submitted my resignation on 29/03/2018 with a notice period end date of 29/05/2018, intending to serve the full two months. However, my Line Management changed the date on the portal to show my last working day as 06/04/2018. I raised this issue with them, explaining that I was prepared to fulfill the complete notice period, but they insisted that they needed to hire a replacement quickly, stating that they were bound to relieve me early.

I pointed out to my management that I had planned my finances based on the expectation of working the full notice period, including monthly EMIs and other expenses. I expressed that had they communicated the need for an early release earlier, I would have adjusted my resignation accordingly. Despite my concerns, they recorded the last working day as 06/04/2018 and the last contractual end date as 25/05/2018, assuring me that I would receive salary up to 25 May 2018, which is corroborated by my documentation.

Following this, they conducted my farewell on 06/04/2018 and revoked all my accesses. Subsequently, on 10/04/2018, my manager contacted me to inform me that it might not be feasible to pay me until 25/05/2018, which I perceive as unfair treatment. It appears to me that the internal management is manipulating employee situations and headcounts for their benefit.

I seek your advice and suggestions on how to address this situation.

Dear friend, There are two important sentences in your post. The first one is "I have all the documents with the date 25/05/2018." Once you were told that your notice period would be curtailed to 06-04-2018, in that case, did you get any written confirmation, or was it just verbal? Your case becomes stronger only if you have written confirmation.

The second statement is "On 10/04/2018 my manager called me that it might not be possible to give you pay till 25/05/2018." Did you record the call? Did you protest against reneging on the assurance?

At this stage, you may put up the application to the MD of your company. In the application, write the sequence of events chronologically. Further, write that your claim for the salary till 25-05-2018 is legitimate and request the issuance of the salary till that date. Attach the evidence of communication, if any.

Lastly, one clarification. Recruitment as well as separation are dealt with by the HR Department. How come in your company "Line Manager" is deciding everything?
