Hi All, Greeting for the day! For Example Employee’s death during working hours and he is working for 3 years in this case, gratuity is applicable or not .

Dear Mr Jithin, Minimum Service of 5 Year is not applicable for Death while in Service.Consequently, Employee in question is eligible for Gratuity for the service rendered

Dear Sir,

I have a query: if any employee's service is less than six months at the time of his death while on duty, will his nominee be entitled to payment of Gratuity under Section 4(c) of the Payment of Gratuity Act, 1972?

If an employee dies even with one year of service, his nominees are entitled to receive gratuity. So 3 year service will definitely entitle for gratuity payment. Srinath Sai Ram please check & know.
