Dear Genius,
My firm is set up in Tiruvannamalai, and here we don't have an ESI hospital in Tiruvannamalai district, Tamil Nadu. Please suggest whether ESI deduction is mandatory even though we don't have an ESI hospital.

No, ESI does not depend on ESI hospitals, but there are areas that are designated by the department. So, go through the area sheet. You can also call the state ESI office to get more information. They are cooperative.

ESI Hospital Setup and Compliance
1. ESIC has its own norms regarding the setup of hospitals under the ESI Act, 1948. Although the scheme is notified in areas with a number of employees, say 1000 or more, and an ESI dispensary is set up, hospitals in such areas are not set up separately. In these areas, ESIC either makes indoor medical treatment arrangements with State Government hospitals or at other locations. It would be beneficial to contact the office of the Regional Director or State Medical Commissioner of ESIC to know the particulars and address of the hospital where indoor medical arrangements for workers in your area have been made.
2. If the area where your factory/unit is located is an implemented area, compliance under the said Act is required to be made compulsorily, even though the indoor medical arrangements have been made at another place or through State Government/private hospitals.
