ESIC and PF Applicability for Small Companies
I am working in an advertising company with a staff of 18 employees. We don't have any deductions except for a Professional tax of 200 RS.
Is the ESIC rule applicable to our company? (Is it for 10 or more employees who are working?) As per my knowledge, for PF, 20 or more employees are required. Is there any specific criteria for industries for both PF and ESIC? How many employees are required to be working for both rules? If yes, then what will be the procedure? I am a little confused.

In most states, the state governments have reduced the criteria/threshold for coverage under the ESI Act, 1948, as per section 1(5), for shops (selected commercial establishments) to employing 10 or more persons on any day. However, I am unsure about the exact position in Maharashtra State.
Since your establishment employs 18 persons, it would be more appropriate to contact the nearest ESIC office and have the records of your establishment verified, if deemed necessary, to determine the coverage position under the said Act.
