Hi all, can anyone solve my problem? I was working with a firm where both my contribution and the employer's contribution to PF were deducted from my salary. After working for 4 years, I resigned from the company. Will I receive back my PF if the employer refuses to sign the PF papers? Please tell me the way or procedure to obtain my claim if my employer doesn’t sign the Employer signature column in the PF form. Can I take action against that employer?

You do not need the employer's signature. Just fill out the form and draft a letter explaining the same, addressing it to the PF Commissioner at the local PF office. All you will need is the employer's PF Code and your PF Number.

Steps to Submit PF Forms Without Employer Signature

Get the signature and seal of an Assistant Commissioner of Labour, Government Labour Officer, or Gazetted Officer (in place of the employer) and submit the same to the PF Office. It is the PF Office's responsibility to obtain information from your employer. Don't forget to fill in the establishment code and your PF account number in those forms.

If the employer refuses to sign the PF withdrawal form, you can forward those forms to the concerned RPFC after mentioning your PF Account number and duly signing at the required places. Gazetted officers' signatures are only taken when PF is to be withdrawn from the closed establishment. Otherwise, in your case, just forward your claim form to the concerned RPFC. The PF officials will send their PF Enforcement Officers to such an establishment, and then they will take some penalty and get a signature from your employer. After that, your PF claim will be settled.

In this case, you can directly submit your PF form to the PF office along with a letter stating that the employer is not cooperating. The PF office will then send your PF directly to be deposited into your bank account.

As per our discussion, all documents (.ex) from 19, from 10c, from 15g, submitted in the PF office. All documents are rejected; I don't know why. Remarks have been given as follows: please attach a xerox copy of the bank passbook or cancel cheque. The claim should be attested by the employer, but the employer did not sign the PF form. What should I do? I do not understand.

No need to get your employer sign, you can fill uan based pf withdrawal form and submit to the pf office.
