Hi, Can somebody help me out in the renewal procedure of a contract labor license? As a principal employer, what is the procedure for renewal and when does the contract labor license need to be renewed or when it expires?

Hi Neeti Raj,

As the principal employer, you have to issue only Form V to the contractor of your organization. Form V is a certificate of engagement of contract labor. The contractor should apply to the concerned Licensing Officer along with Form V for renewal. It should be applied before the expiry date; otherwise, the contractor will be liable to deposit a late fee according to the rules.

The principal employer should obtain a registration certificate which is issued for a lifetime unless it is revoked or suspended.

Hi,

Can somebody help me out with the renewal procedure for the contract labor license? As a principal employer, what is the process for renewal? When does the contract labor license need to be renewed or when does it expire?

Contract labor licenses should be renewed before the 31st of October every year in triplicate using Form VII, along with the license fee and Form V.

Comments on the contract labor license start from January 1st and expire on December 31st. If the license expires two months before, it needs to be renewed for the subsequent year (the license fee is based on the employment strength). The principal employer should provide a Certificate of employment in Form V.

Hi friends,

I have a doubt. Our contractor renews the license each year, but we as the principal employer never gave FORM-5. If I am not mistaken, Form 5 is not required at the time of renewal; it is required at the time of registration only. :confused:

Under Contract Labour ( Regulation & Abolition) Act, 1971. The provisions are like

•Applicability
Applicable to establishments employing 20 or more workmen as contract labour The Act also applies to contractor who employs 20 or more workmen in one establishment.

Duties and Obligations :

Ø-To obtain registration by the principal employer. ( Application in Form I, Registration in Form II)
Ø

Renewal of Registration Certificate : The registration Certificate is issued by the authorities for a specific time perid and need to be renewed after expiration of the same.

Practically : Amendment of Registration Certifiacte is required on following evnts :
1. On chnge in Contarctors,
2. On change in Maximum Number of Contract employes allowed in the RC.
3. On change in adress of the premises.
4. Chabnge in type of business, trade, industry, manufacture or occupation which is carried on in the establishment;
5. Such other particulars as may be relevant to the employment of contract labour in the establishment.

So ideally the amendments in RC are so frequent that need to renewal of RC is rare.

-To maintain Register of Contractors in Form-XII by the Principal Employer
Ø

To issue Certificate of engagement in Form-V to the Contractor
Ø

To obtain licence in Form-IV (if employing 20 or more) in respect of the establishment, by the Contractor.
Ø

( The licence require to be renewed every year by, the contractor in respect of the particular establishment.)

To maintain the following regsiaters by the Contractor.
Ø1. Register of Workmen Form-XIII Rule 75
2. Muster Roll Form-XVIRule 78(1)(a)
3. Register of Wages Form-XVII-do-
4. Wage-cum-Muster Roll Form-XVIII-do-
5. Register of Deductions Form-XX-do-
6. Register of Fines Form-XXI-do-
7. Register of Advances Form-XXII-do-
8. Register of Overtime Form-XXIII -do-

Returns to be submitted to the Registering / LIcensing Authority:

By Principal Employer
Form No.XXV Rule 82(2) Annual 15th February
By Contractor
Form No.XXIV Rule 82(1) Half-yearly 30th January /31st July.


Consequence of Non-Compliance of the Requirements

Any obstruction to an Inspector, in discharge of his duties, refuses or wilfully neglects to provide reasonable facility or refuses to produce any register or other documents, may attract imprisonment upto 3 months or a fine of Rs. 500/- to Rs.1000/- or both.

deposit 270 per person for labour license in gujarat & in central Rs.90 per person. there is no any slab for the deposit or fees, its applicable for all sector .

Dear sir, please help with labor licenses distribution problems in Udham Singh Nagar and Nainital. My license renewal is for 110 in Udham Singh Nagar and 60 in Nainital, making a total of 170. The issue is that online, only 60 licenses are showing up. A letter for tracking purposes is required. Could you please provide a sample letter?

The above information is very useful. Unfortunately, one of my clients delayed the CLRA license renewal. Here, the headcount increased, and we have obtained the amended Form II from the principal employer.

Under this scenario, we want to know whether we can update the headcount and proceed with the CLRA license renewal with the revised headcount. Is it a sequential process on the portal to amend the headcount first and then renew the license post that? We need clarification.
