Dear Amit,

The following registers have to be maintained under CLRA Act and MW Act:

The Contract Labour (Central) Rules, 1971

Form XIII - Register of Persons employed (Sec. 75)

Form XIV - Employment Card (Sec. 76)

Form XV - Service Certificate (Sec. 77)

Form XVI - Muster Roll (Sec. 78)

Form XVI - Register of wages (Sec. 78)

Form XX - Register of Deductions for damage or loss (Sec. 78)

Form XXI - Register of Fines (Sec. 78)

Form XXII - Register of Advances (Sec. 78)

Form XIX - Wage Slips (Sec. 78)

Every contractor shall display an abstract of the Act and rules in English or Hindi and in the language spoken by the majority of workers.

Notices showing the rates of wages, hours of work, wage periods, dates of payments of wages, names and addresses of the Inspectors having jurisdiction, and date of payment of unpaid wages, shall be displayed in English and in Hindi and in the local language understood by the majority of the workers in conspicuous places at the establishment and the worksite by the Principal employer or the contractor.

Every contractor shall send a half-yearly return in Form XXIV (in duplicate), within 30 days from the close of the half-year.

Under THE MINIMUM WAGES RULES, 1950.

FORM - I - Register of Fines

FORM - II (Register of Deductions for Damage or Loss under Rule 21(4))

FORM III - Rule 21 (4-A)

FORM IV - Rule 25(2)

FORM V - Rule 26(5)

FORM IX-A - Rule 22

FORM X - Rule 26(1)

FORM XI - Rule 26(2)

Also, an abstract of the above act should be displayed in the language known to the majority of employees in the establishment.

I would like to know the statutory norms related to eligibility for leaves (PL or earned leave, sick leave, casual leave, and service register) according to labor law. Which leaves are allocated during probation and after confirmation?

All forms as given under the Contract Labour (R&A) Rules, 1971 are provided by Mr. M Peer Mohamed Sardhar on this forum itself. Utilize them if your appropriate Govt. is Central Govt. Otherwise, go through your State Govt. Rules and maintain the registers under those formats.

What's the rule in case a contract employee leaves the job, and his salary is lying unclaimed with the contractor? Is there a specific rule to deal with this situation? Unless the salary is claimed by the concerned person, his salary cannot be claimed by the contractor in the bill submitted to his principal employer. I need a clear picture in this regard as per the proper rules.

It's a pathetic job to maintain all these registers. Instead, they should be maintained in soft copy. We are moving into a fully automated world, yet we are still following these unnecessary, time-wasting old activities. There are so many multinationals and powerful companies. Why don't they recommend the government and put pressure on the government by collectively coming together to automate the process? Where does the money go that we pay as tax? Are we short of brains to do this? I don't understand the same. This will also reduce corruption in the government. But no, we are content with the current situation. No one has the courage to come forward and fight. It's so unfortunate. We are in a poor state.

My client is an IT company. It employs only one person on a contractual basis but has more than twenty people on a contract basis as support staff. Is the company required to get itself registered under the Haryana Contract Labour Act? Also, it is already registered with the labor department under the Minimum Wages Act. Is a separate registration under the contract act required?

Some workers are being worked in an “Establishment /Shop” under contractual arrangement through a Contractor. However neither CLRA License to the Contractor nor CLRA RC to the employer is not applicable there. In such situation, could you please confirm whether have to maintain register under CLRA rules or to maintain register under Minimum wage Rules. Else what would be appropriate.

Dear Vvichu,

Maintenance of registers and records depends upon the applicability of the enactment. If you are not covered under the CLRA Act, then why would you maintain those registers which are required under the CLRA Act? If your establishment is covered under the Minimum Wages Act, 1948, then you are required to maintain registers as per the applicable rules.

- Form-H: Leave book
