We started deducting ESI when we crossed the 10-employee threshold (including two directors) in June 2014. However, soon after, three employees resigned from the company.

ESI Deduction for Remaining Employees

Should we continue paying ESI for the rest of the eligible employees (5 only)?

Stopping ESI for a Smaller Company

How can we stop ESI for a company with 7 employees (including 2 directors)?

Since you have deducted ESI contributions, it is presumed that you have obtained a code number under the said Act. Your unit, once covered under the provisions of the ESI Act, 1948, will continue to be covered irrespective of the fact that the number of employees has reduced below the coverable limit. Even if your unit has only one coverable employee, compliance is required to be made for that one employee. Please refer to section 1(6) of the said Act.
