A staff cannot take leave, i.e., EL/PL, during the notice period. The staff can avail CL/SL in case of an emergency. If the staff frequently takes CL/SL without any emergency, you can extend the notice period for additional days according to the leave policy.

Inform your seniors that we cannot employ people and terminate them without pay for the period they worked. Proportionate pay as per the period worked is mandatory. I am sure your letter of probation would have specified a salary for the employee. That itself is the document which mandates payment of salary on a monthly basis.
