Eligibility for Paid Leave on Intervening Sunday

I came across a situation where one of my contract employees has taken leave on Saturday and Monday and is claiming paid leave for the intervening Sunday. I would like to know whether he is eligible for Sunday as paid leave.

As per work shift plan, if Sunday is a working day for employee, employee may avail leave on Sunday. This is possible, right?

Work Shift and Leave Policy Query

This is a totally different case altogether. The employee is not working on Sundays as it is an off day, and we are not taking any work on Sundays. However, as per the Factories Act, would Sunday be considered as paid leave if the employee was absent on Saturday and Monday?

If one is absent on Saturday and Monday, then Sunday will be considered a paid leave day because it is in continuation with your leave. If one is absent on Saturday and Monday, they will be marked as three days absent for the concerned month, as Sunday will be considered an absent day.

In the case of a contractor employee, the contractor is liable to pay them wages for the leave, but it is your responsibility to ensure it happens.

Dear Mr. Manoj Dwivedi,

If the worker takes leave on Saturday & Monday, then:
His daily rate of minimum wages being paid already includes the wages & allowances for the weekly day of rest (i.e. Sunday). Hence, he/she is not eligible or need not be paid additionally for that Sunday if he has not worked on that day.
