Can anyone please share the procedures and formalities required for change of name of Occupier under factories act? Which form to be used for the factories situated in Uttarakhand?

According to my knowledge, there is no specific form or format for the intimation of a change of occupier similar to a change of manager under the Factories Act. You need to write to the authority about the change of occupier on your letterhead with justification for the change or appointment of a new occupier.

You are advised to approach the authority. The authority will guide you according to its rules and procedures. Rules and procedures change from place to place, office to office. Sometimes, you may find a change from one officer to another within the same office.

For information on the Change of Occupier, there is no specific format required. You can send the intimation to the Chief Inspector of Factories on a letterhead along with the Factory Licence (for a name change in the Factory Licence) and the Resolution passed by the Board of Directors for the Occupier. If the Occupier is also one of the Directors, please attach the list of directors.

Procedure for Change of Occupier under the Factories Act

For a change of Occupier, the required information needs to be filled in the prescribed FORM NO. 2 (under rule 4) of the Factories Act 1948 as an Application for Amendment in the Factory License. Furthermore, a Challan of Rs 50/- as a fee is also required to be deposited. Please contact your area Factory Inspector's Office; they will provide the Blank Challan clearly mentioning the Account Head, duly signed by the authority. If you have any further queries, please contact the undersigned.

1. Form 4 (Notice of Change) duly filled and signed by the occupier and manager of the factory.
2. Copy of Certified Extracts of Resolution Passed by the Board of Directors of the company nominating Mr. XYZ as Occupier under the Factories Act.
3. Latest Particulars of Directors.
4. Copy of Form 32 (Particulars of Appointment of Directors and Manager and Changes among them) pursuant to Section 303(2) under The Companies Act, 1956.

Dear sir,

You are requested to follow the procedure for a change in the Name of the Occupier as outlined below:

- Form 2 in triplicate as per Guj Factories Rules-1963 (Please Refer State Rules for Form Number).
- Treasury challan for Rs. 50/- (Please refer to state rules).
- Original Factory License.
- DIR 12 for Directorship (New Amended Form under Companies Act-2013).
- Resolution of the Board of Directors for the Nomination of the New Occupier.
