Could you please answer the following questions regarding Fire NOC / Fire Licence?

1. When should a FIRE NOC be obtained by an industry? Before, during, or after construction? Before starting operations or during operation?

2. What does the AP Fire Service Act say regarding NOC for an industry?

3. Is the NOC required for construction or for running an industry?

4. How long is the NOC valid? Is it forever or time-bound?

5. If an extra production block is planned, is another NOC required?

6. What about a running industry? Does the Fire Department give NOC for operation?

7. Without a fire NOC, can an industry run legally? If not, why? Which act or rule mandates it?

8. What is a fire licence? To what does it apply?

9. Is the licence valid forever or is it time-bound?

10. What actions can the fire services department initiate on industries as per the act if they do not have a NOC or Licence? Are there any cases of such actions?

Fire NOC Requirements and Renewal

Fire NOC is required after the installation of all fire prevention and protection devices by calculating fire loads. This Fire NOC is issued by the Qualified Chief Fire Officer after an audit (Fire Emergency Services) and must be renewed every year. Although there is no legal requirement, having offsite emergency facilities makes it necessary.

Hi, you referred to the Fire Act. The Fire NOC is required while you seek permission for the commencement of construction. This is applicable only for new constructions after the Fire Act was in force. An industry has the choice to comply with Fire Act provisions for constructions before the Fire Act came into effect. Once the NOC is taken, it has to be renewed every 6 months. The AP local Industrial Development Corporation would not issue a completion certificate if the FIRE NOC is not taken, and this can become problematic in case of any fire or accident. Proactively, it is better to comply with all provisions.

Fire NOC and Compliance Guidelines

1. Apply and obtain a Provisional NOC before construction, and after construction, get the Original NOC.

2. Refer to your State Fire Services Act. We must adhere to the NBC of INDIA norms.

3. See the answer to Question 1.

4. The NOC must be renewed annually.

5. We need to integrate with the existing facility and proceed for inspection.

6. The fire department will issue NOCs for existing installations as well.

7. An NOC is mandatory as per the "AP Fire Services Act." Please review the link: AP Fire Service Dept.

8. The NOC must be renewed annually.

9. See the answer to Question 4 (License or NOC - both are the same).

10. A court case may lead to fines and imprisonment, depending on the severity, and could result in the closure notice of the industry.
