I work in the HR department of a Limited Private company. Due to mental stress, I submitted my resignation in September 2012, but they didn't accept it. As per their request, I continued my duties until the first week of November. However, problems arose again, so I decided to walk out from the company by informing my head that I didn't wish to continue my service. I have now sent my resignation letter again through email, but they are saying that as I am a permanent employee, I have to give one month's notice period. I do not want to go back. Please advise on what I should do.

Dear Suvarna, As per your query, you submitted your resignation in September, but it was not accepted. Since you could not stay long in the company, you informed your boss and left the organization. My question is, did you receive written permission from your head to leave the company?

Now, after submitting your resignation, your company has accepted it and requested you to serve a one-month notice period. You have only two options:

1. To go and serve the one-month notice period and get relieved with a positive note.

2. To go to your company and have a direct talk with your HR along with your superior and try to negotiate your notice period. If your HR agrees that you can pay in lieu of the notice period and do not have to serve it, then it is a positive sign for you.

Also, if you haven't received written confirmation about your departure from your superior, then the period of absence from duty until you resume office to serve your notice period will be treated as leave taken.

Thank you for your reply. Yes, I had given the resignation letter in September, requesting a one-month notice period. Due to some issues, I initially gave it. After some discussion, he promised me that I wouldn't face any further problems and requested me to continue. I believed his words and continued, informing him that if any similar issues arose, I wouldn't resign or provide a notice period. However, on November 8th, another problem occurred that I couldn't control, leading me to quit my job abruptly. Now, they are asking me to shape the behavior of other staff and leave. I am unwilling to do so.

Due to not giving the notice period, they are unwilling to complete my resignation formalities and finalize my settlement.
