Hi,
You should be very clear as to why you are terminating the person. If it is for contravention of any rules or for disciplinary reasons, please be very clear that you cannot take recourse to this action without following the elaborate disciplinary procedure, based on principles of natural justice. This, in other words, means the issuance of a charge sheet, domestic enquiry, and final disciplinary action as per the rules of the organization. Please check this before you embark upon any action.
If the termination letter is a simple termination of the contract of employment, the language of the letter is kept simple and unambiguous:
"In terms of clause ..... of your letter of appointment, we give you ... months' notice (or three months' pay in lieu of notice) for termination of your contract of employment. Your employment will terminate on ....... and you will cease to be in our employment with effect from ..... forenoon. Your legal dues will be settled by the Accounts department during working hours on ....... You are advised to return all the company belongings to the Administrative officer by...."

I agree with Cyril that we should be very clear to ourselves about why we are terminating the person. I have the draft for Disciplinary Action; you just have to include the reason for termination and also include details about the disciplinary actions you have taken before terminating somebody. Because I understand that you can't terminate anybody without giving notice if the employee is permanent. Hope this will help you.

I want to terminate an employee based on building grounds and can at least nail him on the code of conduct (chewing Pan Parag, derogatory comments about senior management, and caste remarks), absenteeism (does not return to the office and no movement update despite several warnings). Also, he has been instrumental in inciting staff to rebel against company policies, etc.
Shall I take it forward?

I think you should first of all give him a memo or written notice. If his behavior doesn't change after that, then you can terminate him. For the disciplinary memo, you can refer to the memo attached by Rinky above.
