Query Regarding ESI Benefits
I have a query regarding ESI benefits. In the case where a person who is not on the company's payroll has worked in an organization for a day or two (the organization has made ESI contributions but he is not registered under ESI) and then meets with an accident, can he claim ESI benefits?
Documents Required for ESI Benefits
If he can avail of benefits, what documents are required by the ESI department for further processing?

Please clarify whether the person met with an accident inside the factory/workplace. Has he submitted the ESI declaration forms to the management?
In my view, if a person works in an organization that is covered under ESI and if an employee meets with an accident, even on the first day of his employment, he is eligible for ESI accident benefits.

The first thing is we need to inform ESIC within 24 hours from the time of the accident. The names will be mentioned at the time of returns, so he will be covered under ESIC from day one. Fill the declaration form and enroll him under ESIC. Take the help of a consultant; they will assist in getting the claims, etc.

Recording Incidents for ESIC
The incident has to be recorded in the Accident Incident register prescribed by ESIC. The attendance (Muster roll copy to ensure the deceased was at work during the time of the accident, etc.) needs to be sent to ESIC within 24 hours.
