Dear Seniors,
One of my employees slipped in our office premises and suffered some serious injuries. He was on leave for six days as the doctor recommended bed rest.
My query is, will this be paid leave? Is there a policy for the same? I request your help in the above matter.

It will be regarded as paid leave. If covered by ESI, you can treat as accident while on duty and if so, payment will be made by the ESI Corporation. Send accident report to ESIC. Regards, Madhu.T.K

Dear Divya,
Is your factory covered by ESIC? If so, in case of an accident, ESI will cover all expenses and provide other benefits. The process is simple - just fill out an accident form and submit it to ESIC. If your factory is not in the notification area, I recommend considering a Workmen's Compensation policy and a GPA (Group Personnel Accident) policy. This way, you can claim according to the policy norms.

You have mentioned that an employee slipped and suffered serious injuries, but you have not clarified whether the employee is covered by ESIC (salary up to Rs. 15,000/-) or not covered by ESIC (salary is more than Rs. 15,000).
If the employee is covered by ESIC, ESIC will make the payment of the salary if ESIC prescribes leave.
If the employee is not covered by ESIC, it is the decision of management whether they want to give him paid leave or not, or want to adjust his leave (such as Sick Leave or Privilege Leave). In reality, these days will be adjusted from Sick Leave or, if insufficient, from Privilege Leave.

Dear Divya,
Obviously, he is entitled to paid leave if he is out of ESI. If he is on IP, then it doesn't matter; you have to submit an accident form to the concerned branch office and leave the problem for ESIC. It is mandatory for you to submit an accident form regarding the injured employee who is covered under the ESI Act when the accident occurred on the premises and was supposed to be in the course of and in connection with employment. In case yours is a factory, the factory inspector should be informed about the accident.
