Hi, I am working in a software development company. The salary is paid on the 2nd, 7th, and 15th of the next month. As far as I know, it is not allowed to pay salaries or wages after the 7th day of the next month when there are not more than 1,000 employees. My salary is 21,000, and the total number of employees does not exceed 1,000. Please suggest to me on this.

Welcome to CiteHR. Without delving into the question of the applicability of this Act to your establishment, you are not entitled to any relief under this Act. This is because, as per sec. 1(6) of the Payment of Wages Act, 1936, nothing in this Act shall apply to wages payable in respect of a wage period which, over such a wage period, averages ten thousand rupees a month or more.

In my opinion, you should review your applicable State Shops & Establishment Act to explore the relief available in that Act regarding the timely payment of wages.

I didnt understand that Are you getting your salary in 3 parts ? Or are different people getting salary on different dates ? (if so, what is the wage period ?)

Kindly elaborate on your query. Are you not receiving your salary at all, is it not being paid on time, or are you receiving your salary in three installments on different dates? Please provide more details so we can assist you better.

The whole point is "delay in wages," right? Refer to Section 15 of the same Act. The provision provides certain exceptions, probably Section 15 clause (3). I am not sure exactly, but refer to Section 15. Also, refer to the Payment of Wages (Procedure) Rules.
