I had been working as a teacher in a public school in Delhi since 1999. I worked on an ad-hoc basis for 2 years, i.e., 1999-2001, and then got probation in 2001. I resigned last year, and the 3-month notice period ended in the first week of November 2011. I submitted the gratuity form then and later an application as a reminder. However, the school authorities have not yet given me the gratuity amount. What should I do now?

Approaching the Authority for Gratuity Denial

If you have been denied gratuity, you can approach the Authority under the Payment of Gratuity Act. The authority may be either the State Labour Officer or the Central Labour Commissioner (Assistant Commissioner), depending on whether your school is under the State or Central jurisdiction. Please remember that this has nothing to do with the syllabus being followed by your school, such as the State Board, ICSE, or CBSE. Generally, a private school within a state boundary will be under State control, while a school management having institutions in other states will fall under Central jurisdiction for the purpose of labor Acts.
