In our organization, we have allotted 21 days as PL. Can any of the group members please clarify:

1. Can the employee avail one or two days of leave as PL (exclusive of CL and SL)?
2. What are the slabs for encashment and carry forward?

Yes, the employee can avail 1 or 2 days of PL, similar to CL and SL. It is as per the employee's requirement. Normally, the encashment of PL will be done when the employee leaves the job or the company. However, if the encashment of leave (up to a maximum of 300 days) is required, the employee can apply for leave encashment while availing the PL for LTA.

It all depends on the company's leave policy. Some companies may prescribe a minimum number of days, such as four or six, to avail of PL, as casual leave is intended for one or two days, even for brief indisposition. To me, this policy appears reasonable; otherwise, PL will be reduced to the status of CL if allowed for just one or two days.

As per the Factories Act of 1948, one day of leave is mandatory after working for 20 days. So, if the number of days in a year is 365, then does the calculation for paid leave (PL) come to 18.25? If not, should PL be calculated as 300/20 = 15 or 16 days? Also, is it mandatory to make payment based on the actual days worked to calculate PL for 15 days?
