Hello all!
An employee from my organization stopped coming after 2 days of working with us, the third day I received his reply to my email saying that he is not interested to pursue the job further. Now, he is asking for his salary for those 2 days. There was no hiring documentation signed with him, is he still entitled to the 2 days salary. And also what are the legalities involved if we don't pay him.

This is what many HR are making mistake by not giving the appointment on the date of joining and not filling the employee application form on the same date of joining. Only when problem come we know the seriousness of the problem.
See if he is asking for 2 days salary then ask him he has to serve the notice period(hope u would have a minimum notice period for probation employees)
You have not given the appointment letter or you have not received the signed copy from the employee. else do as follow
Send 3 notice to the employee that he has to serve the notice period.
next send a termination notice to him.
Now you are very strong in your side to proof that he is an absconding employee.
send an F & F calculation where you have to recover the money from the employee.
Surely he will never come to your side.

there are no legalities if you dnt pay him. he is not eligible for pay in any manner. he is just trying his luck. moreover, it will put him in a mess if he tries to act unusually

How can you send notice to an employee and ask him to submit notice period when you have not issued appointment letter or offer letter.
I fully agree with you, 3 Absconding letter and then a letter which mentions that your services are no longer required.All the letters to be send through Registered post and the receipt of the same to be maintained.That is All.

we received a job at other state
where we quoted for complete job bu due unavailability of instruments our staff people has to stay idle for 15 days
and
finally we completed the job in 45 days
party do not paying us for those days where our peoples are idle and we had to paid their lodging & all expence
at the end we billed and find that we are getting loss of 30 thousand in that job.

He won’t get anything. He is not entitled to get anything. He has absconded after TWO days, so treat him the same way as you treat other absconding employees.

Please make me clear one thing.........if the unavailability of instruments was from your side then they can do the same.If they were supposed to provide the instruments and culdn't, then in that case they they are supposed to pay for all days.

Dear all,
on what basis you will send absconding letter to employee, it is a big mistake at your part, not issuing appointment letter instead of working two whole days. If their is not appointment letter signed by the employee, on what basis you will send the letter , if the terms and conditions of appointment not agreed by the employee.
Just do simple thing ask the employee to come and collect the dues, and all the requisit form completed. It is not a big issue to pay 2 days salary.
