One employee has applied for leave. There is no leave balance, so we will treat it as a loss of pay. I doubt the person was on leave from 01.11.2011 to 22.11.2011. There are 22 days and 3 Sundays (weekly offs) within that period. Sundays (weekly offs) are also treated as a loss of pay in our company. What are the rules and regulations concerning this matter?

Understanding Weekly Holidays and Leave Without Pay

The law, referring to the Factories Act, states that after the 6th day of work or after completing 48 hours in a week, a day off should be given as a weekly holiday without wages, not as a weekly holiday with wages. Therefore, in your case, since the person has not worked 48 hours in a week and has taken the entire week on Leave Without Pay (LOP), Sundays should also be considered as LOP days.

If any employee is on leave Monday to Wednesday , then what about his weekly off on Sunday?

Hi, An employee on leave from Monday to Wednesday means 3 days of leave to be deducted from the leave balance. Sunday is the weekly off, so it should not be considered as leave. However, if the employee is on leave from Friday to Wednesday, the weekly off in between should also be adjusted against the leave.

When an employee is availing leave at a stretch for more than 2/3 days, the intervening weekly off shall be counted as leave only and not a weekly off day

Sir if the employee is in leave from Thursday to Wednesday. Then Sunday will be treated as leave or weekly off ????? Please clarify.

Hi, In this case (Thursday to Wednesday) it has to considered as continuous leave including week ends.
