My name is Darshan, and I am working as an HR Executive. I need your help. Can you please let me know whether only the factory manager is authorized to sign all the correspondence related to various government departments such as Factory Inspectors, Labour Department, Pollution Control Board, PF, ESIC, Excise, Sales Tax, etc., or can someone else be the signatory? If yes, is there any procedure to change the authorized signatory?

Any person who is authorized by the occupier can sign all documents related to all departments concerned.
1. FACTORY INSPECTOR (SEND THE FORM TO CHANGE THE MANAGER FORM 2A)
2. LABOUR DEPARTMENT ALSO SENDS THE AUTHORITY LETTER ATTESTED BY THE OWNER, OCCUPIER, OR FACTORY MANAGER.
3. POLLUTION CONTROL BOARD DOES THE SAME.
4. ESIC SENDS THE LETTER OF SIGNATURE ATTESTED BY THE OCCUPIER OR DIRECTOR OF THE COMPANY.
5. FOR CHANGES IN EPF, SEND FORM 5A WITH A COVERING LETTER.
6. FOR EXCISE AND SALES TAX, YOU MUST MAKE AN AUTHORITY ON THE STAMP PAPER OF 100/- AND THE AUTHORIZATION MUST BE ATTESTED BY AN ELIGIBLE AUTHORITY.

In the scenario where the company wishes to add an additional signatory, a board meeting must be conducted to pass a resolution for the same. The details of the board meeting and resolution must be recorded in the minutes' book.
Subsequently, you should forward a copy of the board resolution to all relevant statutory departments. Draft a letter explaining the addition of an authorized signatory in our company for signing all necessary documents, reports, and correspondence when needed.
