Hi all, I would like to have clarification on the following points:
1. If an employee leaves a company before completing his probation and according to the offer letter, it is not necessary to submit a notice period during probation. However, he still gives 15 days' notice. Will he receive salary pay for the notice period (15 days)?
2. Is the notice period counted as working days or non-working days?
3. If a person submits a notice period of 15 days at the start of a particular month and his last working day is the 15th of that month, what will be his number of working days in that particular month? Also, is he liable to receive the salary of that particular month in his full and final settlement?
Kindly provide your opinion on the same. I am looking forward to an insightful discussion.

During the said notice period of 15 days, if he works, he is naturally eligible for that 15 days' salary. Why should there be any confusion? His full and final settlement will be calculated, taking into consideration only that 15 days' salary.

Even if it is not required, and a person gives a notice period during his/her probation, he/she is liable for 15 days' salary. As Madhu said, there is no confusion at all.

Working Days in Feb. '11: 07 days
Casual Leaves: 05 days
Earned Leaves: 11 days
Total Days: 23 days
Less: Notice Period 15 days
Balance days (Paid): 08 days
Total amount paid for 08 days is Rs. 5710/- with Rs. 10000/- last month balance.
The person served a 15-day Notice Period from 1st Feb '2011 to 15th Feb '2011. Out of these 15 days, he was on approved leave for 7 days with the consent of his Reporting Manager.
So, as per my understanding, he should receive 24 days' salary for that month (15 Days Notice Period + 9 Days Leave Balance), considering 7 days (8th Feb '2011 - 14th Feb '2011) adjusted.
Please confirm if this calculation is correct.

You still need to understand some important things before making any full and final decision regarding the above-mentioned employee.
a) The notice period given by the employee is for 15 days; however, his actual working days are only 7 (including weekly off or holidays). How are the monthly wages calculated - by 30 days or 26 days?
b) Please do not include CL if he/she has not applied for it, and do not adjust EL during the notice period if it is not required by law. If your company follows this practice, then there is no issue with including all leaves.
c) At the time of full and final settlement, you need to consider the total working days + CL if he/she has already applied for it + wages of EL balance in his/her leave account.
