Hi, Is there any specific date by which salary for previous month has to be paid. Are there any exceptions? My wife gets salary on 25th of following month. Is this valid case? Regards, AMit

As per the Payment of Wages Act 1936, the salary date is within 7 days if the number of employees is below 1000 and within 10 days if the number of employees is equal to or above 1000, after completion of the month. However, the protection of the Act will be provided for a salary up to Rs. 10,000.

Please find out the reason for the delay in payment. If the payment is made every month only by the 25th of the following month, then from the very beginning, you could have objected. When accepting the job, the question of the date of the salary does not arise. Only when we attain self-sufficiency do we start discussing the date of the salary, rate of salary, mode of payment, legal implications, etc. If you had addressed this in the first month and claimed your rights from the office, no one would have stopped you; in fact, everybody would have supported you. But after tolerating it until now, if you wake up now, think about where the mistake lies.

It's not worth suing your employer unless you have decided not to work anymore and have a lot to recover from them. Going to court is a costly matter.
However, it is a bad practice not to give salary within 7 days of the month end. It reflects badly on the organization. It may be a good idea for your wife to look for another job. Many times, a delay in salary is due to the company's inability to manage cash flows or due to losses. If not, then it's a reflection of the attitudes of the owners that they do not care to pay their employees on time. Either way, it's not a good place to be.
