By virtue of an amendment in the Payment of Gratuity Act in December 2009, private school teachers who were not included in the definition of employees as per the Supreme Court decision are now within the definition of employees due to the amendment made in Section 2E. Additionally, Section 13A has been added. The effective date of these changes is April 1997. Therefore, private school teachers who retired after April 1997 should approach their school management for the payment of gratuity. If denied by the school management, they may approach the State Labour Court for appropriate directions.
