hI... Could any one send me the Enquiry procedure of Disciplinary Action against the misconduct. How many copies of enquiries procedure would be made? regds mridula

1. Prepare a Charge Sheet showing the charges against the accused.
2. Appoint an enquiry officer to investigate the matter.
3. If the charges are proven, inform the accused about the findings of the enquiry officer and ask the accused, through issuing a Show Cause, why a particular penalty or penalties should not be imposed upon him. Also, give him an opportunity for a personal hearing.
4. If the authority is not satisfied with his explanation, the penalty is imposed.

There is no set procedure for an inquiry. It should be conducted as per the principles of natural justice. Individuals should be given all opportunities to explain themselves. The inquiry should be conducted in three copies.

Disciplinary Action - Enquiry Procedure

1. Prepare a charge sheet along with charges, time, and date.
2. Appoint an enquiry officer for investigation, but keep in mind that he/she should not be connected in any way with the case.
3. Issue a show cause notice to the accused. The signature should be made by the inquiry authority, not by the inquiry officer.
4. If the answer of the accused is satisfactory, then prepare the report showing all the procedures and get it signed by both parties.
5. If the accused denies the charges, then the inquiry officer investigates whether the explanation is correct.
6. The inquiry officer will submit his report to the inquiry authority, but he has no right to suggest the punishment.
7. Based on the severity of the offense, management will decide the punishment for the person.
8. The accused can appeal against the management's decision.
