We are in the Telecom industry (Service Providers). Most of our staff are trainees, from whom we deduct TDS. I would like to set up a standing order, but I don't know the procedure or the required documents.

Standing Orders are mandatory for those having not less than 100 employees. Standing orders are framed following the Industrial Employment Standing Orders Act of 1946. There is a model standing order given in the Act itself. Draft it accordingly, get it certified, that's all.

Dear Sumathi,

I am well and wish you the same.

I am attaching 2 model standing orders for your reference and record.

You have to do the following:

01. Modify the standing order wherever you want as per your organization's policy and rules.

02. If you are having a union, then the union rep has to sign; otherwise, select 3 loyal employees from the list.

03. Submit the draft standing order (one copy) to the Commission of Labour (certifying authority) of your region.

04. He will verify and correct the standing order as per the government norms.

05. Get back the corrected standing order and prepare 5 copies of the same, and also 5 copies in the local language.

06. The corrected/verified copy will be sent to the local labor inspector, and he will come for inspection. He will call the union, and if there is no union, he will discuss with the selected employees, explain the terms and conditions of the standing order, and get their concurrence. Then, all the employees have to sign as a token of acceptance. A copy will be displayed on the official notice board.

07. Then he will submit his report to the Commissioner of Labour.

08. Again, the Commissioner of Labour will call the management rep and union rep, or if not available, the selected 3 employees for signing.

09. If any corrections have to be made before certification, they will be corrected, and the opinion will be acknowledged.

10. Then it will be certified.

11. The certified copy of the standing order has to be displayed on the notice board.

12. One copy has to be given to all the employees for their reference and record.

This is the general procedure. It may vary from state to state.

Is it mandatory to translate a Standing Order in other language as Hindi for understanding of labour.
