Hello All, I started working in 2014 and worked for that company until 2018 (Company 1). In 2018, I joined another company and am currently working there (Company 2).

At Company 1, I completed all necessary documentation after my departure, including the release letter, experience letter (provided after 4 months of departure), and full and final settlement (issued after 4 months of departure). All documents were provided with positive reviews.

However, in 2024, after almost 6 years, when I attempted to transition to Company 2 and apply to an MNC, Company 1 provided negative reviews during the MNC's background verification process. They claimed that I shared the company's private data to secure a position at a competitor company, thus violating their policies. These allegations are entirely false. Company 1 is attributing this to the high turnover rate, as most employees left within 2 years.

What steps can I take in this situation?

Steps to Address False Negative Review from Previous Company

🔍 Investigate the Allegations:
- Request specific details from the MNC about the negative feedback provided by Company 1. Understand the nature of the allegations and gather evidence to refute them.

📝 Gather Evidence:
- Collect any documentation, emails, or communication that can support your case and prove that the allegations are false. This may include your employment records, performance appraisals, and any relevant correspondence.

📞 Contact Company 1:
- Reach out to the HR department or a senior official at Company 1 to discuss the situation. Provide your evidence and seek clarification on why they provided negative feedback during the background verification process.

📄 Legal Consultation:
- If the issue persists and affects your career prospects, consider seeking legal advice to understand your rights and options under Indian labor laws regarding defamation or false accusations.

🤝 Mediation:
- Explore the possibility of mediation between you, Company 1, and the MNC to resolve the misunderstanding and clear your reputation. A neutral third party can facilitate constructive dialogue.

📃 Request Correction:
- Politely request Company 1 to rectify the negative feedback provided to the MNC and issue a revised statement that accurately reflects your tenure and conduct during your employment.

🔗 Maintain Professionalism:
- Throughout the process, maintain a professional demeanor and focus on resolving the issue amicably. Avoid confrontational or aggressive behavior that could escalate the situation.

📌 Document Everything:
- Keep a record of all communications, meetings, and actions taken to address the false negative review. This documentation may be valuable if further steps are necessary.

🔍 Follow Up:
- Regularly follow up with both Company 1 and the MNC to track the progress of resolving the issue. Persistence and proactive communication can help expedite the resolution process.

Taking proactive steps to address the false negative review from Company 1 can help safeguard your professional reputation and ensure fair treatment during background verification processes.
