One of our employee joined 01/04/2014 and left on 27/03/2023. His total service is 9 years and his date of birth is 03/05/1960 i.e. 63 years. Now i am in confusion how to make his full and final along with Gratuity. Is retirement age 60yrs. Kindly advise if gratuity will be made on 60 yrs or 63 yrs.

Hi,

There is no age limit to receive Gratuity.

As per Payment of Gratuity Act,1972 eligibility criteria for Gratuity is based on continuous period of service with the same employer. ( Which should not be less than 5 years but for death cases this will not apply). So Gratuity to be calculated till the last the working day of the employee irrespective of the age of the employee. So please pay Gratuity till the last working day which is 27.3.2023.

Gratuity is paid on exit of employees and who have met eligibility conditions.Age does not matter in this case.
