I have completed 8 years of service in my current organization and have now resigned to switch jobs to a new company. However, my notice period here is 90 days, but I do not want to serve the full notice period as I intend to join the new company in 30-40 days. If my current organization does not release me and I am forced to leave, will I still receive my gratuity for the 8 years of service?
I understand that they may consider me absconding and may not provide me with an experience letter, but I would like to know if they will withhold my gratuity amount.
Thank you.

Hello,
You can talk to your reporting manager or management for the same and smoothly try to convince them because you have to complete the clearance process. If you do not serve/complete your notice period, the employer will deduct NP recovery from your salary. If you are unable to serve the notice period, then you can buy out the notice period by paying the equivalent amount of your salary for the days that you are not working during the notice period.
You are eligible for gratuity benefit, and you will also receive the gratuity benefit.
There's nothing to worry about; put your problems transparently before management, and you will get a positive response!
