Dear team I am working I'm sales department and my target is not reached they have given me 1 week to resign or else they will terminate me I wanted to know in which case I will get notice pay - if I chose to resign HR telling me "depends on us on our review" so you will get or not - is it true or for notice pay should I choose termination to get notice pay please help me here

Dear Faizen,
At any cost, your employer has decided to do away with your services. At this juncture why should you be so bothered about the notice pay? Even if you resign, it is you who should pay the notice salary in lieu of notice. Therefore, let them straight away terminate you for not achieving the sales target. Such a sudden termination on account of poor performance without following the formal disciplinary procedure is illegal and can be successfully contested in the labor court.

Dear Faizen,

Your employer has decided to remove from the services on ground of non-performance. They have intimated you either resign or else they will terminate. They want resignation because they want to avoid legal complicacy that may arise out of your termination.

Now you have left with an option to challenge the termination. This legal procedure is a time taking matter and make your future time worse, decide whether you are in a position to do that. The outcome may be and may not be on your favour. No employer is generally prepared to take a terminated employee and see them in a strange manner.

The other option is to resign and leave the company. In this situation you can tender resignation with notice, hopefully they may consider it. You should now focus on how to get new job because there is nothing much left for you. You decide what to be done by discussing with your well wishers.

Dear Faizan
No a days it is the general practice of most of the organizations to give threat of termination for non performing sales employees.
As the word termination has very powerful impact, thus employee resigned by them self under pressure & worry of getting terminated.
None of the organization can terminate an employee on immediate basis because of non performance untill & unless they have given you enough chance in writing (PIP) to improve your performance. Once you failed to improve during the PIP then company may terminate your services on ground of poor performance.
As they have given you fair chance to improve your performance.
You can speak with the HR of your company & tell them to provide you chance for improvement, which can be monitored on monthly basis at least for 60 days.
My advice to you will be do not get in to the pressure & trust me they will not be able you to terminate from the employment, if they do so then they have face legal complications.
Also to give you more clarity & support if your company go with the termination then they have to clear your due within the two days of your termination, as per the Shop & Establishment Act of Telangana.
So do not get in to the undue pressure just perform well, our wishes are with you.
