I have a query regarding early release during COVID-19. If a person is in the resignation period and is required to serve a three-month notice, but the company's HR department insists on an early release of approximately 60 days instead of the full 90 days, should the company compensate the employee for the remaining 30 days?

According to company policy, they typically do not grant early releases by one month, but this was an exception due to COVID-19. The company policies are one-sided and not in favor of the employees. It is important to note that this is a case of early release, not a layoff or termination.

Could you please advise on whether the employee is entitled to the remaining 30 days' salary or not?

You are entitled to the salary for the remaining notice period as the early release amounts to a counter-offer by the employer that requires your consent. Inform the employer to include the notice salary in your F&F; failing which, you will have to recover it along with damages for breach of contract by means of a Civil Suit.
