Hi,

I have resigned from Company A with a 2-month notice period. I stayed in this company for 11 months before resigning. Although I gave the company a 2-month notice, they let me go just 5 days after I submitted my resignation.

According to my contract, if I leave within 12 months, I am required to pay the joining costs. In my situation, if the company had allowed me to serve the full 2-month notice period, my total time at the job would have been 13 months, and there would have been no issues.

Now, am I still liable to pay the company's joining costs? Please guide.

Hi,

Not at all. When the company itself is ready to relieve you much before the notice period, they cannot charge you for anything. Only when the employee asks the employer to be relieved without serving the notice period would the employee be liable to pay the amount. In this case, you would not be required to pay the amount.

Dear Friend,

It's not required, but I suggest you keep a xerox copy signed by the authority on your resignation letter, mentioning your date of release. This will help you in any situation.

Hi,

A company cannot ask you to pay joining costs. In my view, when you have given them two months' notice and they relieved you within 5 days, they have made a mistake, and you are entitled to receive notice pay because you had planned to leave after two months, and they relieved you within 5 days.
