I am serving notice period .My notice period is 3 month. According to my company HR my 3 months salary will go on hold and I will get that after last date (After 45 days of last date ). Company policies will be like that?? We cant do anything in that?

Even such a condition is incorporated in the notice clause of the contract of employment, it is certainly illegal as it is opposed to public policy u/s 23 of the Indian Contract Act,1872. Even otherwise, with holding of salary for the notice period actually served by the employee and its disbursement after 45 days is certainly a breach of the contract of employment which will end up in paying of damages if agitated in a Civil Court.
